In a bold move,
the Aam Aadmi Party (AAP) government in Delhi has knocked the Supreme Court’s
door challenging the Centre's recent ordinance on the transfer and posting of
officers.
The government
argues that the ordinance violates the constitution by bypassing Article 239AA
and wresting control away from the elected government, placing it instead in
the hands of an unelected Lieutenant Governor (LG).
This development comes after the Centre promulgated the ordinance on May 19, granting itself authority over the transfer and posting of IAS and DANICS officers in the national capital.
The Arvind
Kejriwal-led government promptly criticized this move as a direct challenge to
the Supreme Court's verdict on the issue of service control.
Until the Supreme
Court's May 11 ruling, the LG held executive control over the transfer and
postings of all officers in the Delhi government, excluding those related to
police, public order, and land. However, the court's decision granted greater
authority to the elected government, prompting the Centre's subsequent
ordinance.
Delhi's Chief
Minister, Arvind Kejriwal, has been actively rallying opposition parties
against the Centre's ordinance. To further demonstrate their discontent,
Kejriwal and his cabinet ministers plan to symbolically burn copies of the
ordinance on July 3 at the party office in central Delhi. This protest will
extend across all 70 assembly constituencies in the capital, as copies of the
ordinance are set alight on July 5. From July 6 to July 13, every nook and
corner of Delhi will witness the burning of the ordinance, orchestrated by the
party's seven vice presidents.
The Delhi
Government's move to challenge the Centre's ordinance in the Supreme Court
reflects their determination to protect their constitutional rights and
maintain democratic governance. The upcoming protests serve as a powerful statement
against what the AAP perceives as an overreach of power.
