AAP MLA Naresh Balyan has petitioned the Delhi High Court for bail after a trial court rejected his application in a case under MCOCA. He faces allegations of involvement in an organized crime syndicate. The prosecution has raised concerns over the potential for witness tampering and interference in the investigation.

AAP MLA Naresh Balyan has approached the Delhi High Court for bail after a trial court denied his previous application under the Maharashtra Control of Organized Crime Act (MCOCA).
Balyan, arrested on December 4, 2024, is accused of involvement in an organized crime syndicate led by Kapil Sangwan. The trial court, in a ruling on January 15, 2025, rejected his bail plea, citing substantial evidence connecting him to unlawful activities. Special Judge Kaveri Baweja noted that Balyan appeared to be an active participant in the group’s ongoing criminal activities.
The Delhi Police opposed the bail, alleging that Balyan served as a "facilitator" for the syndicate, particularly helping its members evade arrest and funding their activities. Special Public Prosecutor Akhand Pratap Singh argued that granting bail could lead to witness tampering and obstruction of the ongoing investigation.

Balyan's lawyers contend that the evidence presented is insufficient to directly link him to the crimes, arguing for his release. The High Court is expected to hear his petition on January 22, 2025.
The case involves 16 FIRs filed against the members of the syndicate, which is accused of extortion, violence, and other criminal activities in Delhi.
