Amit Malviya Calls Out Arvind Kejriwal for Ignoring Supreme Court Verdict on LG's Power; Controversy Ensues

Amit Malviya, a member of the BJP, stated that Arvind Kejriwal, the Chief Minister of Delhi, had not thoroughly read the Supreme Court's verdict issued on May 11. Malviya argued that the recent ordinance, which has sparked significant political controversy, aligns with the court's judgment.

 

He took to Twitter to express his opinion, asserting that Kejriwal's strong opposition to the ordinance was unnecessary because the ordinance is derived from the Constitution Bench's judgment and will subsequently be presented as a bill in Parliament.

 

The controversy erupted on Friday when the Central government introduced an ordinance granting the Lieutenant Governor (LG) executive authority over service matters. This action reignited the ongoing conflict between the Centre and the Delhi government, with the Aam Aadmi Party (AAP) announcing its intention to challenge the ordinance in the Supreme Court.

 

Former Jammu and Kashmir Chief Minister Omar Abdullah, along with other opposition leaders, condemned the ordinance.

 

The BJP defended the necessity of the ordinance, accusing the Kejriwal government of intimidating officials after the Supreme Court's verdict. According to reports from the LG office, eight officers lodged complaints of "blatant harassment" by the Kejriwal government. Two complaints were received before the court's verdict, and an additional six were filed afterward.

 

Among the officers who complained were the Services Secretary Ashish More, Chief Secretary Naresh Kumar, Special Secretaries Kinny Singh and YVVJ Rajasekhar, and Power Secretary Shurbir Singh. Rajasekhar was responsible for overseeing the case involving the renovation of Kejriwal's residence.

 

Amidst the ongoing conflict, Malviya highlighted that the Supreme Court's verdict had provisions for a law that could modify the LG's executive power. He referred to paragraph 95 of the Constitution Bench's judgment, which expressly mentioned that if Parliament enacts a law granting executive power on any subject within the purview of the National Capital Territory of Delhi (NCTD), the LG's executive power will be modified accordingly.

 

Furthermore, Malviya pointed out that Section 49 of the Government of National Capital Territory of Delhi (GNCTD) Act states that both the LG and the Council of Ministers must adhere to specific directions issued by the President on certain occasions.
