Bombay HC Quashes FIR Filed by Virat Kohli and Anushka Sharma:-

Justices AS Gadkari and PD Naik sat on the Bombay High Court’s bench looking into the Matter filed by cricketer Virat Kohli and his wife cum actress Anushka Sharma. The two complaints had filed an FIR against a Twitter user who had posted derogatory rape threats for their infant daughter, Vamika.

Details of The Case

The accused, Ramnagesh Akubathini, is a software engineer aged 25 years and a graduate of IIT Hyderabad. On 24th October 2021, when the Indian team lost the T20 World Cup under the captaincy of Virat Kohli, cricket fans channeled their anger against Kohli in various ways. 

However, in an absolutely overt act, Mr. Akubathini posted rape threats for Kohli and Sharma’s 10-moth old daughter, Vamika, on Twitter which was totally unacceptable to the family.

The lawyer representing Akubathini was a part of P Vas and Company. He argued that the accused was a meritorious student who had been interning with prestigious firms, and he had no criminal antecedents. 

Taking up a technical argument, the lawyer also stated that there was no evidentiary proof to show that the comment posted originated from the IP address of the device that Mr. Akubathini was using at that time.

The Bombay HC’s Decision

The decision of the Bombay HC came only after Kohli’s manager, Aquilia D’Souza, consented to drop the charges against Mr. Akubathini. The court also observed that amidst the large magnitude of tweets, not all tweets might have been directly addressed to Kohli or his family. 

However, the case still leaves an unsettling impression on the minds of rational thinkers. Is an Indian cricket fan’s interest in the game justified enough to disrespect the personal Space of players representing the national team?
