Gujarat University Remarked “Irresponsible Childish Curiosity” on Controversy Related to PM's Degree

On 9th of February (Thursday), PM Modi’s degree certification from Gujarat University was held under controversial allegations, as against the misuse of public domain position to seek correct information of PM’s educational qualifications. The argument rages against providing Prime Minister Narendra Modi degree Certificate to Delhi Chief Minister Arvind Kejariwal by Gujarat University. University have allegedly held debates pertaining the issue to as “irresponsible Childish Curiosity” The case was in regard of the “Right of Information”(RTI ACT)  application based on a 7 year old ‘Central Information Commission’. The Right of Information Act enacted in 2005 gives the authority to provide information to all the citizens of India, be it, of public importance, administration, decisions to maintain transparency and accountability of documents. The right gives the access of any kind of documents to the general public. Under the provision of the act, the citizens can access the documents, be it a body of Government or instrumentality of state, expeditiously, within 30 days.  Gujarat University Gujarat University Gujarat University urged the court to dismiss RTI act as it says; “irresponsible childish curiosity cannot become public interest under the RTI Act.” The university Council argued that merely if someone holds a public office, it doesn’t allow him/her to penetrate into the privacy of anyone, if that is not connected with public activity. University also revealed that the details of degree certification had been published on the website in the past, one can revert to that anytime. However, advocate Percy Kavina claims that there is no details provided on the website for the same.  Judgments after hearing both the sides of the case Justice Biren Vaishnav reserved his order against petition filed by the University of Gujarat challenging the CIC order.  In April 2016,CIC M Sridhar Acharyulu ordered the University of Delhi and Gujarat to publish information of educational qualifications on the website and to provide the details to Delhi Chief Minister Arvind Kejariwal.  Three months after, the university held the CIC order asking Ahmedabad based University to issue the documents of required information.  Arvind kejriwal did filed suit against the PM under RTI act, he had no objection on the Right to citizens to maintain privacy of records under the domain of Government. But, he argued, why would the Commission ‘hide’ information of PM’S educational background.  Citing Judgements  Considering some past judgments of the Supreme Court and high courts about the exemptions granted under section 8 of the RTI Act, Mr. Mehta said one cannot seek someone’s personal information “just because you are curious about it”. So many people who are not connected are curious about so many things…A stranger cannot seek such information. Irresponsible childish curiosity cannot become public interest.
