The occupancy rate of Indian prisons stands at 130% which means that a large chunk of people occupy prisons and laws governing their life must be at par with the changing needs of the society.
CM Yogi Adityanath’s Plan of Prison Reforms in Uttar Pradesh
On 15th of June 2023, CM Yogi Adityanath, at a high-level meeting, directed the authorities to prepare a draft which would replace the Prisoners Act of 1900. CM Yogi Adityanath proposed that open jails should be set up for the majority of the criminals in Uttar Pradesh while high barracks and hardened protection must be limited only for habitual criminals or those who have been convicted of grave and heinous offenses.
Need for Prison Reforms in Uttar Pradesh
The current state law, the Prisoners Act, 1900 is one that had been formulated in the pre-British era. Uttar Pradesh CM Yogi Adityanath said, “The purpose of the Jail Act 1894 is to keep the criminals in custody in a disciplined Manner, but we have to focus on reformation and rehabilitation. In such a situation, keeping the future in view, we need to implement new laws.” The prison reforms would seek the integration of a wider idea of reformative theory of criminal law to the existing prison system in Uttar Pradesh
