UP Government Enforcing Irrational NSA:-
The Supreme Court has always acted as the obstructive pillar standing before political parties and Ruling governments with biased political agendas. In yet another instance of such a magnitude, the Supreme Court has acted as the hurdle before the UP government from invoking the National Security Act (NSA) against Yusuf Malik, a member of the Samajwadi Party.
Stand of The Supreme Court
The Apex Court, through a Bench consisting of Justices Ahsanuddin Amanullah and Sanjay Kishan Kaul, was "amazed" to observe that the UP government had been using the National Security Act in a trivial case that included issues of recovery of revenue from the property. The Court stated, “It is a case of non-application of mind by the authorities and improper procedure. We are quite amazed NSA is being invoked in cases for recovery of revenue for the property. We quash the proceedings and set him free forthwith.”
Absolute Abuse of Legal Procedure
Allegedly, politician Yusuk Malik had prevented government officials from discharging their functions of redeeming the property revenue from his relatives. Against this, the UP government invoked the NSA.
It is pertinent to understand the gravity of the National Security Act. The NSA is invoked in cases where the security of citizens or localities of the country is under threat. It is legislation that concerns the public at large and not private matters between two parties concerning the exchange of money.
Political parties often use such powerful legislation to vent their political agenda and anger against politicians from other parties. The action of the Supreme Court regarding the matter in terming the acts of the UP government as an ‘abuse of legal process’ has been an apt action to Make political parties more accountable for their actions.
