Adidas claimed that Thom Browne Inc. and Adidas, both are companies dealing in sports apparel primarily and that Thom Browne used the goodwill of Adidas by choosing a similar logo as that of Adidas, in order to highly price his products.

The advocates on behalf of Thom Browne Inc. have pointed out that the customer base that the Company caters to is much different from that of Adidas. The target audience for Thom Browne belong from richer economic classes than those of Adidas.

Moreover, Adidas had also raised concerns over a 3- striped logo which was previously used by Thom Browne, however, since the concern was reasonable, Thom Browne changed the logo by increasing one stripe. The harassment faced by Thom Browne in the hands of the giant Company, Adidas has also been highlighted as an argument. Adidas has engaged the Company in around 90 trademark cases and 200 agreements of settlement since 2008, all relating to the new 4- striped logo of Thom Browne Inc.
