Delhi Court Seeks Medical Opinion on Injuries of Abused Minor

A Delhi court has requested a medical opinion on the injuries of a seven-year-old girl allegedly abused by her adoptive family. Despite retracting her allegations, the court suspects coercion. The judge summoned doctors to review her medical reports before deciding on the bail plea of her adoptive brother, accused of abuse.

A Delhi court has sought a medical opinion on the injuries sustained by a seven-year-old girl, allegedly subjected to severe abuse by her adoptive family. The court raised concerns about the child's sudden retraction of allegations and the possibility of external influence on her testimony.
Additional Sessions Judge Gomati Manocha, while hearing the bail plea of the girl’s adoptive brother—accused of physical and sexual assault—summoned the doctors who had conducted her medical examination in February 2023. The judge emphasised that despite the child later attributing her injuries to accidents, the medical findings suggested otherwise.
The case surfaced when school authorities noticed injuries on the child and alerted child protection services. In her initial complaint, the girl accused her adoptive mother of inflicting severe cruelty, including burns, cuts, and physical beatings. She also alleged that her adoptive brother tied her up, suspended her from a ceiling fan, and physically assaulted her. However, she later changed her testimony, raising suspicions of coercion.
The court noted that the child’s biological parents, who regained custody, were also under scrutiny for not reporting the alleged abuse. Judge Manocha expressed concerns that the minor might have been pressured or tutored to alter her statements.
While the defence argued that the accused had been on interim bail for a year without violations, the court maintained that the severity of the alleged crimes warranted further investigation. The judge reiterated that the medical report would be crucial in determining the authenticity of the allegations before deciding on the bail plea.

The court has directed the doctors to provide a detailed opinion on the nature and possible causes of the injuries before proceeding further with the case.
