Legal Battle at Taco Bell: Accused of Deceptive Ads and Skimping on Fillings

On Monday, in a
federal court in Brooklyn, Frank Siragusa, New York resident, accused the fast
food chain of deceptive marketing. He claimed in the lawsuit that the Mexican
Pizza he bought in September 2022, had only half the beans and beef as
advertised on their website and in the store.
According to the
lawsuit, other well-known items on the Taco Bell menu, like the Crunchwrap
Supreme, Grande Crunchwrap, and Veggie Mexican Pizza, have also exaggerated the
filling quantity in their advertisements, allegedly exceeding the actual amount
by "at least double."
In the lawsuit,
Siragusa included pictures of the advertised products as well as images of the
noticeably less substantial items customers reportedly received.
The lawsuit
argues that such practices are unjust and misleading, particularly worrisome
during a period of increasing food prices.
Siragusa is
pursuing a $5 million claim on behalf of customers who bought Taco Bell menu
items impacted by deceptive advertising.
Interestingly,
the lawsuit coincides with Taco Bell's recent resolution of the trademark
dispute with Taco John's over the "Taco Tuesday" phrase, with the
taco chain winning the right for the phrase to be used by everyone.
James Kelly and
Anthony Russo, Siragusa's lawyers, have a history of filing similar claims against
fast food establishments for purported false advertising, which includes a
recent case against Burger King for exaggerating the size of their Whoppers.
The Burger King lawsuit underwent mediation but reached a deadlock.
