Supreme Court Issues Notice to Centre, Delhi Governor amid AAP v BJP Delhi Ordinance Row

The Supreme Court (SC) has decided not to
immediately halt a controversial ordinance granting the central government
authority over bureaucrats deputed to the Delhi government. However, the court
has issued notices to the centre, led by the Bharatiya Janata Party (BJP), and
Delhi's Lieutenant-Governor (LG) in response to a plea filed by the ruling Aam
Aadmi Party (AAP). The AAP has strongly criticized the ordinance, labeling it
as unconstitutional.
The court has allowed the AAP to include
Delhi Lieutenant-Governor VK Saxena as an additional respondent, and he has
been served a similar notice. The next hearing on this matter is scheduled for
July 17.
The Delhi government has condemned the
ordinance, stating that it is an attempt to "override" the Supreme
Court's previous ruling. The government has accused the central government of
disregarding the fundamental principles of the Constitution.
Referred to as the "black"
ordinance by the AAP, this legislation was promulgated by the central
government in May. It establishes an authority, independent of the elected
Delhi government, to handle the transfer and posting of senior civil service
officers in the city-state.
The AAP strongly criticized this move,
especially since it came shortly after the Supreme Court had affirmed that the
elected AAP government should have legislative and executive control over
administrative services in the national capital, with the exception of matters
related to land, law and order, and the police.
The Supreme Court, in a five-member bench
led by the Chief Justice, stated that an elected government must have control
over bureaucrats; otherwise, the principle of collective responsibility would
be compromised.
The promulgation of this ordinance sparked
widespread protests from the AAP and other opposition parties. In an attempt to
garner support and counter the BJP's efforts, the AAP has been actively seeking
alliances with other opposition parties. Chief Minister Arvind Kejriwal has
held meetings with influential leaders such as Mamata Banerjee, the Chief
Minister of West Bengal, Nitish Kumar, the Chief Minister of Bihar, and Uddhav
Thackeray, former Chief Minister of Maharashtra, appealing for their support.
