On 18th May 2023, Union Law Minister Kiren Rijiju was replaced by Minister Arjun Ram Meghwal. Meghwal has now been given total independent charge of the Ministry of Law

and Justice besides the Minister of State for Parliamentary Affairs and Culture.

The Reason behind The Cabinet Reshuffle

Kiren Rijiju holds a degree in law from Delhi University. It was a shocker to see Kiren Rijiju being replaced by Arjun Ram Meghwal as the Minister of Law.

However, behind this cabinet reshuffle lie some critical points of ideological differences between the Indian judicial system and Kiren Rijiju.

Kiren Rijiju has criticized the system of appointment of Supreme Court judges for a long time. He has called the Collegium’s methods of appointment “opaque” and full of favoritism.

Kiren Rijiju has criticized the system of appointment of Supreme Court judges for a long time. He has called the Collegium’s methods of appointment “opaque” and full of favoritism.

According to Kiren Rijiju, since no fixed procedure is disclosed during the selection of judges for the higher judiciary, the Supreme Court judges end up choosing and promoting those whom they know or are acquainted with. Kiren Rijiju opines that such practices are “alien to the Constitution.”

Response of The Supreme Court to Kiren Rijiju’s Opinion

The Supreme Court has not welcomed the opinion of Kiren Rijiju with open arms. During his tenure, Rijiju tried to bring reforms in the system of appointing judges of the Supreme Court for a long time.

However, Supreme Court judges, for instance, Sanjay Kisha Kaul J, responded by saying that the Parliament cannot turn the whole judicial process upside down simply because it does not like it.

However, Supreme Court judges, for instance, Sanjay Kisha Kaul J, responded by saying that the Parliament cannot turn the whole judicial process upside down simply because it does not like it.

The Supreme Court also did not give any importance to the statements of Kiren Rijiju. It refused to entertain a plea in which defamatory remarks made by Kiren Rijiju against the Supreme Court were in question.

The top Court said that the “credibility of the Hon’ble Supreme Court of India is sky-high, it cannot be eroded or impinged by the statements of individuals.”
