Arvind Kejriwal moves to Supreme Court against his liquor policy case arrest

After Delhi High Court denied his appeal, Chief Minister Arvind Kejriwal brought his case contesting his detention in relation to the inconsistent excise policy in Delhi to the Supreme Court. Regarding the excise policy scenario, the Enforcement Directorate detained Kejriwal on March 21 of this year.

The Delhi High Court denied Kejriwal's appeal on Tuesday against the ED's arrest of him over the excise policy issue. The court ruled that Kejriwal's arrest and the ensuing remand could not be classified as "illegal."

Advocate Rishikesh Kumar, who represents the Chief Minister of Delhi, reportedly stated that they had every right to dispute the order before the Supreme Court.

According to Kumar, Arvind Kejriwal's unlawful imprisonment has been contested, as reported by ANI. The High Court found that there were valid grounds for the defendant's arrest and that the remand order was lawful after considering the matter. The conclusion made by the High Court constituted the basis for today's decision. We are keeping our options open in case the verdict is appealed at the Supreme Court as we wait for the order. We will immediately submit a challenge with the Supreme Court as soon as the detailed order is available.

At this point, the bench of Justice Swarna Kanta Sharma declared that the ED have sufficient proof to apprehend Kejriwal. The impact of Kejriwal's disengagement from the probe and the delay he induced were being felt by those in judicial detention.

In addition, the court has stated unequivocally that it considers the accused to be in custody and that the circumstances surrounding his incarceration should be considered lawfully rather than in light of the upcoming election. The ED was not found to be dishonest, hence the court determined that Kejriwal's case, which focused on the arrest's timing prior to the general elections, could not be upheld.

The Enforcement Directorate (ED) has determined, based on its examination of the facts, that Arvind Kejriwal used and hid money from his illegal operations and was a part of a criminal conspiracy. He was associated with the AAP both personally and as the group's convenor, according to the ED's investigation.
