Assam CM Seeks Public Input on Proposed Law Against Polygamy; Legislation Expected Soon

Assam Chief Minister Himanta Biswa Sarma has called for public suggestions regarding the state government's plan to introduce a law prohibiting polygamy. 

The move comes after an expert committee suggested that the Assam assembly has the authority to enact such a law. 


A committee has been established in Assam to review the jurisdiction of the state legislature to adopt legislation to decriminalize polygamy

In a notice shared on social media, the chief minister cited that while religious freedoms are protected by Articles 25 and 26, they are subject to public order, morality, and legislative provisions for social welfare.

The notice highlighted that court rulings indicate that having multiple wives is not an essential practice in Islam, and therefore laws favoring monogamy are within the bounds of "social welfare and reform." 

The government asserted that Assam has the legal competence to introduce a state law against polygamy based on these principles.


During the 77th celebration of Assam's Independence Day, Sarma said that new laws will be introduced soon to stop polygamy.

The expert committee, led by retired Justice Rumi Kumari Phukan, had submitted its report to Sarma on August 6. The committee unanimously agreed that the state could establish its own legislation to end polygamy. Sarma affirmed that a "strict act" will be introduced shortly to address polygamy within the current fiscal year.

Speaking during Assam's 77th Independence Day celebrations, Sarma reiterated the forthcoming legislation to curb polygamy. The proposed law aims to align with the state's commitment to social welfare and reforms.
