Family of Sanitation Worker Killed in Accident Awarded ₹64.73 Lakh Compensation by MACT

Thane’s MACT awarded ₹64.73 lakh to the family of sanitation worker Premdas Jadhav, who died in a 2021 road accident caused by a rashly driven truck. The tribunal held the driver and insurer liable, recognising Jadhav’s revised salary under the 7th Pay Commission and ruling out contributory negligence.

The Motor Accident Claims Tribunal (MACT) in Thane has granted a compensation of ₹64.73 lakh to the family of Premdas Chindhu Jadhav, a sanitation worker who died in a road accident in 2021. The ruling, delivered by MACT member R V Mohite on Tuesday, held the truck owner and insurance company jointly liable for the payout, along with 9% annual interest from the date of filing the claim.

Jadhav, 48, was employed with the Bhiwandi Nizampur Municipal Corporation and had been a permanent staff member since 1999. He was returning home to Sange village on his motorcycle on the night of September 26, 2021, when a truck, driven at high speed and on the wrong side of the road, crashed into him near Bapgaon Naka. He died on the spot.

An eyewitness confirmed the truck was moving in a rash and negligent manner. The Padgha police registered a case under relevant provisions of the IPC and the Motor Vehicles Act following the incident.

Jadhav’s wife and three children filed for compensation citing both pecuniary and non-pecuniary losses. The tribunal found no contributory negligence on Jadhav’s part and rejected the insurer’s claim that the truck driver was unlicensed.

The tribunal also acknowledged salary records provided by the municipal corporation, confirming that Jadhav’s earnings had been revised under the 7th Pay Commission. Of the total ₹64.73 lakh awarded, ₹48.28 lakh was allocated for loss of future income, with the remainder covering other damages, including emotional and financial loss to the family.

The ruling is seen as a significant recognition of the rights and entitlements of public service workers and their dependents in tragic circumstances.
