The Supreme Court on Friday rejected a public interest litigation (PIL) that aimed to prevent a coalition of 26 opposition parties from using the acronym I.N.D.I.A (Indian National Developmental Inclusive Alliance) for their alliance.
The bench, led by Justices Sanjay Kishan Kaul and Sudhanshu Dhulia, deemed the plea as a mere attempt to gain publicity. Consequently, the petitioner, Rohit Kheriwal, decided to withdraw the PIL.
Interestingly, last month, a group of 26 opposition parties, led by the Congress party, declared their intention to form a united front to contest against the ruling Bharatiya Janata Party (BJP) in the upcoming Lok Sabha elections next year. They revealed their plan to participate in the elections under the banner of I.N.D.I.A, which stands for Indian National Developmental Inclusive Alliance.
Coincidentally, on August 4th, a similar PIL was submitted to the Delhi High Court. The court issued a notice to the opposition parties and the Election Commission of India in response to this PIL, which sought to prevent the use of the I.N.D.I.A acronym.
The petitioner, activist Girish Bharadwaj, argued that using the name INDIA violates Sections 2 and 3 of The Emblems and Names (Prevention of Improper Use) Act 1950. The Chief Justice of the Delhi High Court, Satish Chandra Sharma, along with Justice Amit Mahajan, called for the political parties and the election body to provide their responses to the petition.
