In a recent development, the Ministry of Home Affairs (MHA) has taken the decision to prematurely retire a senior bureaucrat, AV Prem Nath, who has been under suspension due to molestation charges. According to MHA authorities, this decision was made in the public interest and in line with the authority granted to them by Rule 42 of the CCS (Pension) Rules 1965 and sub-rule 1 of Rule 56(j) of the Fundamental Rules.

AV Prem Nath was suspended from his position as an officer in the Delhi government's Urban Development department. He was a member of the 1997 batch of the Delhi, Andaman & Nicobar, Lakshadweep, Daman and Diu, and Dadra and Nagar Haveli Civil Services (DANICS) cadre. A case against him for molestation of a juvenile in Uttarakhand was the reason for the suspension.

It is noteworthy that Prem Nath had previously raised allegations against the special secretary (vigilance) of the Delhi government, claiming that the appointment had been secured through a "fake" caste certificate. He had filed an official complaint regarding this matter.

The decision to retire Prem Nath is based on the grounds of integrity and effectiveness in the public interest, as provided for in the rules governing government officials' premature retirement. These rules grant the Center the "absolute right to retire" officials who are found lacking in integrity or are ineffective in serving the public interest.

During the course of the investigation into his conduct, five separate FIRs were registered against Prem Nath. Among these, one was filed by the Anti-Corruption Branch of the Delhi government. These FIRs alleged that Prem Nath had amassed properties disproportionate to his known sources of income.

The premature retirement of AV Prem Nath sends a strong message regarding the government's commitment to upholding integrity and accountability within its ranks, and it serves as a reminder of the consequences of misconduct among public servants.

This incident highlights the importance of maintaining the highest standards of conduct and ethics in the civil service, ultimately safeguarding the trust and faith of the public in the government machinery.
