The Calcutta High Court, in a landmark decision, resolved the legal tussle between the Bharatiya Janata Party (BJP) and the Trinamool Congress (TMC) government. The court granted permission for a mega rally at Victoria House in Kolkata's bustling Esplanade area. Scheduled for November 29, the event includes a significant address by Union Home Minister Amit Shah.

The legal battle ensued after the TMC government attempted to thwart the BJP's rally plans, submitting a plea to halt the demonstration. However, the High Court, led by Chief Justice TS Sivagnanam and Justice Hiranmay Bhattacharya, dismissed the TMC's petition, upholding the earlier single-judge bench ruling favoring the BJP's rally.

Emphasizing the procedural aspect, the court highlighted that the application for the rally was submitted 23 days in advance, complying with the prescribed timeline outlined in the advisory. Additionally, the bench acknowledged the prevalent occurrence of processions, meetings, and rallies in West Bengal, particularly in Kolkata.

BJP leaders welcomed the verdict as a historical win, expressing gratitude to the judiciary for allowing the event. West Bengal BJP President Sukanta Majumdar lauded the decision, asserting that the government's attempt to obstruct their program had been rightfully overturned.

The court's decision was preceded by scrutiny of the Kolkata Police's actions, as the High Court reprimanded them for denying rally permissions without substantial reasons. The BJP's initial application for a rally on November 28 also faced rejection, raising concerns about the denial of permissions without valid grounds.

The verdict not only secures the BJP's right to hold the rally but also sets a significant precedent regarding the conduct of political gatherings in the state, reinforcing the importance of due process in such situations.
