H-1B Visa Holders

Canada’s Immigration Minister, Sean Fraser, has unveiled a new initiative that will allow 10,000 American H-1B visa holders to work in Canada through an open work-permit stream. The program aims to attract skilled workers, particularly from the technology sector, who have been affected by job cuts in the United States.

Alongside the work permits, the program will also extend study or work permits to the family members of H-1B visa holders.

Starting from July 16, 2023, H-1B visa holders and their immediate family members will be eligible to apply for relocation to Canada. Successful applicants will receive open work permits that are valid for up to three years, allowing them to work for any employer in the country.

In addition, spouses and dependents will have the opportunity to apply for temporary resident visas, including work or study permits as needed.

While specific details regarding eligibility and the number of participants were not provided, Fraser stated that the government intends to establish an immigration stream to attract highly skilled individuals to Canada’s tech industry, regardless of whether they already have job offers.

The H-1B visa, which permits temporary work in specialized occupations, has been impacted by layoffs in the US tech sector during the pandemic. Canada’s decision to welcome American H-1B visa holders reflects its commitment to attracting global talent and strengthening its technology industry.

By providing an inclusive and supportive environment, Canada hopes to leverage the expertise and contributions of skilled professionals from around the world.
