A sessions court in Delhi has rejected the applications for interim stay on trial moved by Delhi Chief Minister Arvind Kejriwal and Aam Aadmi Party (AAP) Rajya Sabha member Sanjay Singh in a criminal defamation case. The case was filed by Gujarat University regarding alleged defamatory statements made by the two leaders in connection with Prime Minister Narendra Modi's degree.
The court of sessions judge AJ Kanani turned down the pleas for interim stay on trial, stating that there were no grounds to provide such relief. The next hearing in this matter has been scheduled for August 21, following a request for time by respondent Gujarat University.
Kejriwal and Singh had contested the metropolitan court's summons in a defamation case and sought interim relief from the sessions court while their main plea was pending. However, their motion was refused by the court.
The metropolitan court had called both leaders to appear on August 11, after remarking that there appeared to be a case against them under section 500 of the Indian Penal Code (IPC). The defamation complaint originates from their comments made in response to a Gujarat High Court judgement regarding PM Modi's degree.
The leaders' comments were slammed as being "sarcastic" and "derogatory" towards Gujarat University. The university's registrar, Piyush Patel, filed the defamation complaint, alleging that the comments hurt the institution's standing and reputation.
The politicians have threatened to go to the Gujarat High Court for redress after their request for an interim stay was denied. The defamation dispute between the two leaders centres on comments made during press conferences and on social media, and the court's refusal emphasises the ongoing legal war between them.
The difficulty Kejriwal and Singh face in dealing with the legal consequences of their comments on the university and the Prime Minister's degree scandal was highlighted by the court's decision to deny their request for temporary relief.
