Organ removal from a donor is a significant surgery that necessitates time for recuperation, including both hospitalization and post-hospitalization periods, according to an official memorandum (OM) published by the Department of Personnel and Training (DoPT).
A central government employee may also be eligible for up to 42 days of special casual leave for organ donation as an additional welfare measure in the public interest. This decision encouraged organ donation among central government employees and supported the noble activity of helping another human being.
The length of special casual leave shall be limited to 42 days, at the discretion of a government-registered physician or medical practitioner, regardless of the type of surgery used to remove the donor's organ, the directive stated.
Following the Transplantation of Human Organs Act of 1994, "If a living donor has been appropriately approved for donation by a government-registered medical professional, the leave will be granted to all live donors."
The Personnel Ministry announced that it has been talking with the Ministry of Health and Family Welfare about extending special casual leave to organ donors in light of the referrals and inquiries it has received.
The special casual leave may only be combined with any other departure if extreme circumstances, such as surgical difficulties, are suggested by a government-registered physician following the directive provided to all central government departments and ministries.
Starting on the day of hospital admission, special casual leave must typically be taken over a few days. On the advice of a physician or medical practitioner registered with the government, it might be obtained starting no later than one week before surgery, if necessary, stated. It may be possible to allow for leaf flexibility or splitting.
Depending on the treating physician's or doctor's recommendation, as far as possible, treatment related to organ donation must occur at an approved facility.
It stated that the production of a medical certificate adequately certified by the concerned HOD of the hospital is required when no authorized hospital (government hospital or private hospital impaneled In the region or zone of treatment, care is offered by a private hospital and is covered by the Central Government Health Scheme (CGHS).
