The US court has approved India's request for the extradition of Tahawwur Rana, a Canadian businessman of Pakistani Origin, who is wanted for his role in the 2008 Mumbai terror attacks. India had filed a complaint for Rana's provisional arrest in June 2020, which was backed by the Biden administration. Rana will now be sent to India to face trial.
Jacqueline Chooljian, a US Magistrate Judge from the US District Court Central District of California, stated in a court order of 48 pages dated May 16, made public on Wednesday, that she has thoroughly examined and taken into account all the submitted documents supporting and opposing the request.
Additionally, the judge considered the arguments presented during the hearing.
After thoroughly reviewing the case, taking various factors into account, and providing a detailed explanation, the judge has determined and officially confirmed that Rana can be extradited to India. Rana was apprehended in the United States based on India's request for his involvement in the mentioned attacks.
The National Investigation Agency (NIA) in India is investigating Rana's alleged involvement in the 2008 Mumbai attacks carried out by the Pakistan-based Lashkar-e-Taiba (LeT) terrorists. The NIA is prepared to take action to bring Rana to India using diplomatic channels.
During court hearings, US government lawyers claimed that Rana knew about his childhood friend David Coleman Headley's association with LeT and aided him, thereby supporting the terrorist organization and its partners.
The US government believes that Rana was involved in the planning and discussion of the 2008 Mumbai terror attacks, including targeting certain locations. They have accused him of being part of the conspiracy and committing the crime of terrorism.
Rana's lawyer is opposing his extradition. The attacks resulted in the deaths of 166 people, including six Americans, and involved 10 Pakistani terrorists who carried out a 60-hour siege at various locations in Mumbai.
Federal prosecutors asserted that due to the conspiracy's deliberate actions causing fatalities or their awareness of the highly perilous nature of these acts, there exists substantial evidence to fulfill the requirements for murder charges.
The judge has determined that the extradition of Rana to India falls entirely within the scope of the existing treaty between India and the United States.
A judge stated that India has charged Rana with several offenses, including conspiracy to commit murder, forgery, and terrorism, for which an arrest warrant has been issued. The judge found these charges to be extraditable offenses under the applicable treaty and within India's jurisdiction.
The judge determined that there are enough credible evidence to establish a reasonable basis to believe that Rana is the person who has been accused and sought extradition by India. It has been concluded that Rana indeed committed the mentioned offenses, for which India has requested extradition.
As a result, the judge has ordered that Rana be held in the custody of the United States Marshal until a Final decision is made regarding extradition and surrender to India for trial, per the relevant laws and treaty provisions.
