Husband Iqbal Ahmed Held Guilty of Murder of Wife on The Basis of 9-year old Daughter’s Eyewitness Testimony

A horrific incident of murder of one’s own spouse has surfaced from Bareilly in Uttar Pradesh. More surprisingly, the testimony of the 9-year old little daughter of the couple is the piece of evidence which has now put her father behind bars for murder.

Details of The Incident

The victim has been identified as Nisha Devi. Nisha Devi was reportedly murdered by her husband, Iqbal Ahmed several years after their marriage when the couple was also blessed with two children. Nisha and Iqbal had a love marriage but soon after their marriage, Nisha realized that the ‘Raju’ whom she loved was actually named, ‘Iqbal Ahmed’ and was a married man. Nisha was his second wife. Soon, Iqbal began coercing Nisha to change her religion to Islam, to which Nisha resented. The fights escalated into the murder of Nisha by Iqbal and the same was witnessed by their 9-year old daughter.

Strength of A Minor’s Testimony

According to the Indian Evidence Act, a minor’s testimony is not placed with heavy reliance unless it is extremely consistent and believable. In this case, the young daughter’s testimony corroborated with all the medical and documentary evidence produced before the Court. As a result, the Court rightfully placed reliance on the minor daughter’s testimony and sentenced Ahmed to imprisonment for murder and wrongful actions under the Uttar Pradesh Prohibition of Unlawful Religious Conversion Act.
