Kapil Sibal Announces Impeachment Motion Against Allahabad HC Judge Over ‘Hate Speech’

Kapil Sibal plans to introduce an impeachment motion against Allahabad HC’s Justice Shekhar Kumar Yadav over alleged hate speech at a VHP event. The Supreme Court has taken note, with critics questioning judicial impartiality and integrity. The process under Article 218 could remove the judge for violating constitutional obligations.
Rajya Sabha MP and senior advocate Kapil Sibal declared plans to introduce an impeachment motion against Justice Shekhar Kumar Yadav of the Allahabad High Court. Justice Yadav allegedly made anti-Muslim remarks during an event hosted by the Vishva Hindu Parishad (VHP).
Sibal, also the president of the Supreme Court Bar Association (SCBA), revealed he has consulted with several other lawmakers, including Digvijaya Singh and Vivek Tankha, regarding the motion. “Any judge who makes such statements violates their oath of office and has no right to remain in their position,” Sibal asserted during a press conference.
The Supreme Court has taken cognizance of Justice Yadav's speech and has sought details from the Allahabad High Court. Sibal urged that no cases be assigned to the judge, emphasizing the judiciary’s role in upholding constitutional values.
The impeachment of a High Court judge is governed by Article 218 of the Indian Constitution. It requires a formal process initiated in Parliament, including substantial support from lawmakers, and a detailed investigation.

The speech has ignited widespread criticism. Asaduddin Owaisi, among others, has condemned the participation of a sitting judge in a VHP event and the nature of the comments made. An NGO has written to Chief Justice Sanjiv Khanna, urging an inquiry into the matter.
