The Allahabad High Court has dismissed the habeas corpus petition filed by a Muslim father-in-law requesting the release of his daughter-in-law.

Justice Shamim Ahmed, in line with Muslim teachings, said that marriage constitutes an agreement between two parties where the husband assumes the obligation of providing his wife with protection and housing. If there are any problems, the husband has the authority to find solutions through the proper channels, whereas the father-in-law lacks the required status.

The situation involved a Muslim man who brought forth a petition of habeas corpus, claiming that his daughter-in-law had been wrongfully restrained by her parents since 2021, hindering her ability to go back to her marital residence.

 

The individual who requested legal assistance urged the court to intervene to liberate his daughter-in-law from the purportedly unlawful restraint imposed by her parents.

 

While the proceedings were ongoing, it was disclosed that the detainee's spouse was presently living in Kuwait and supporting himself. The lawyer representing the government opposed the request, stating that it could not be considered valid as it was submitted by the father-in-law instead of the husband.

 

Justice Shamim Ahmed asserted that the unlawful detention of the detainee could not be assumed due to her husband's absence from their shared residence and her current living situation with her parents. The court hypothesized that the detainee possibly made a deliberate decision not to go to her husband's home while he was away.

 

Based on these factors, the court determined that the father-in-law did not have the proper authority to bring the current request and therefore dismissed the matter.
