Allahabad High Court

The Allahabad High Court has suspended the survey in the Gyanvapi complex until August 3, pending a verdict on a plea against the Varanasi district court's order. The district court had directed the Archaeological Survey of India (ASI) to conduct a survey to determine if the Gyanvapi mosque was built on top of a temple.

The plea was filed by Anjuman Intezamia Masjid, which manages the Gyanvapi mosque. Their counsel, SFA Naqvi, argued that the admissibility of the suit filed by five plaintiffs was still under consideration by the Supreme Court. He pointed out that it was individuals from various parts of the country filing separate suits and not the trust or temple authorities.

Gyanvapi Complex
Allahabad High Court suspends the Gyanvapi Complex survey until the August 3 verdict. Plea against ASI's temple-mosque survey awaits Supreme Court decision.

Naqvi presented photographs of digging equipment found on the mosque premises when the ASI arrived, suggesting their intention to excavate the site. However, a senior ASI official assured the court that there were no plans to damage the mosque during the survey.

Representing the Hindu side, counsel Vishnu Shankar Jain cited Hindu religious symbols on the walls of the mosque and claimed the presence of Hindu artifacts within the structure. He argued that Mughal emperor Aurangzeb did not construct new buildings while demolishing the temple but that Muslims later built a superstructure on the remains.

Chief Justice Diwaker asked the ASI to demonstrate the survey process to the court. In response, Alok Tripathi, Additional Director of ASI, submitted an affidavit detailing the survey process.

Verdict
The Allahabad High Court has suspended the survey in the Gyanvapi complex until August 3, pending a verdict on a plea against the Varanasi district court's order.

Naqvi contested the previous court's conclusion that the issue could not be decided without a survey report, stating that the materials were not adequately examined. He also objected to the ASI being directed to conduct the survey without being made a party to the suit.

The court's final verdict on the ASI survey is now set to be delivered on August 3. Until then, the survey remains suspended in the Gyanvapi complex.
