Rahul Gandhi Moves Supreme Court In Modi Surname Defamation Case

Congress leader Rahul Gandhi has moved the Supreme Court after his plea for a stay on his conviction was dismissed by the Gujarat High Court.
In March of this year, Gandhi was convicted and sentenced to two years in prison in a defamation case filed by BJP Gujarat MLA Purnesh Modi.
The case stems from remarks made by Rahul Gandhi during a Karnataka election rally in 2019, where he commented on the common surname "Modi" by saying, "how come all thieves have Modi as the common surname?" The statement led Purnesh Modi to file a criminal defamation case against Gandhi.
The Surat court found Rahul Gandhi guilty of criminal defamation and handed him a two-year prison sentence along with a fine. Despite appeals made to both the Surat district court and the Gujarat High Court, no reprieve was granted, and the conviction was upheld. Moreover, both courts criticized Rahul Gandhi for his remarks.
Rahul Gandhi's legal team waited for the conclusion of the Supreme Court's summer vacation period before challenging the conviction in the higher court.
Meanwhile, Purnesh Modi, the plaintiff in the case, has filed a caveat in the Supreme Court, ensuring that his arguments will be heard if Rahul Gandhi or any other concerned party challenges the decision made by the Gujarat High Court. The caveat emphasizes the importance of granting Purnesh Modi an opportunity to present his side before any decision is made by the court.
In the original Surat trial, held on March 23, Rahul Gandhi was convicted under sections 499 and 500 of the Indian Penal Code (IPC) for criminal defamation. He had sought a stay on the conviction and appealed the order in a Surat sessions court. However, despite being granted bail, the court refused to stay the conviction on April 20. Subsequently, Gandhi approached the Gujarat High Court.
