The Supreme Court of India has halted all bulldozer demolitions until October 1, pending new guidelines. The decision addresses concerns about the misuse of demolitions linked to alleged criminal activities, aiming to ensure that property demolitions follow legal procedures and respect individual rights.
In a significant ruling, the Supreme Court of India has temporarily halted all bulldozer demolitions across the country until October 1. The court's directive applies unless the demolitions are conducted on public roads, water bodies, or railway lines. This decision follows criticism of the practice known as "bulldozer justice," which the court deemed inconsistent with the principles of law.
The ruling came in response to a case involving municipal authorities in Gujarat who had threatened to demolish a family’s home due to an alleged criminal connection of one family member. The petitioner argued that demolishing the home, where three generations have lived for over two decades, violated principles of justice and fairness.
The Supreme Court has announced that it will develop guidelines to regulate property demolitions under municipal laws. Justices Hrishikesh Roy, Sudhanshu Dhulia, and SVN Bhatti expressed concerns that demolitions based on alleged criminal activity of a family member could unjustly affect the entire family and their legally established residences. The court aims to create a standardized procedure ensuring that demolitions are conducted with proper notice and legal recourse.
The new guidelines will address how and when properties can be demolished, aiming to prevent misuse and ensure adherence to legal standards. The Supreme Court's intervention seeks to balance the enforcement of municipal laws with respect for legal rights and procedural fairness.
