The Supreme Court’s Decision on Compensation Enhancement in Bhopal Gas Tragedy Case Posted on March 15, 2023 News By Akta Yadav 344 Views Supreme Court:- A curative petition was filed before the Supreme Court by the Centre in 2010 demanding an enhanced compensation amounting to more than 7,000 crores for the victims of the 1984 Bhopal Gas Tragedy. As evident from the facts, the curative petition was filed after a gap of more than two decades after the Bhopal Gas Tragedy. The Bhopal Gas Tragedy of 1984 The Bhopal Gas Tragedy occurred at Union Carbide India Limited plant located in Bhopal, Madhya Pradesh and is counted among the most dreadful industrial disasters of the world. The Bhopal Gas Tragedy had caused the deaths of more than 3,500 people by the leakage of around 45 tons of a poisonous gas called methyl isocyanate. The Bhopal Gas Tragedy went a long way to teach the world a lesson regarding mandatory safety protocols and standards of industrial infrastructure. Supreme Court Supreme Court on Bhopal Gas Tragedy Curative Petition The Supreme Court provided its judgment today (14th March 2023) on the Bhopal Gas Tragedy curative petition and refused to entertain the request put across by the Centre. On behalf of the Supreme Court, Justice Kaul expressed in the decision, “We are unsatisfied with the Union of India for not furnishing any rationale for raking up this issue after two decades ... We are of the view that curative petitions cannot be entertained.” The Supreme Court also pointed out that the compensation that was provided to the victims of the Bhopal Gas Tragedy earlier by Union Carbide Corporation was enough to relieve the Company from its liability and moreover, Rs 50 crore of the amount paid as compensation by Union Carbide still remains with the RBI as it is unutilised. The Way Ahead Although the Supreme Court did not entertain the plea of the Centre regarding increased compensation to the Bhopal Gas Tragedy victims, it urged the Centre to recognise its responsibilities to fill the gaps if any in extending equitable relief to the victims. The Centre was ordered to act upon the insurance policies that were planned to be extended to the victims of the Bhopal Gas Tragedy which have not been acted upon by the Centre till date. With this, the Supreme Court reiterated that the Centre cannot act negligently on its part and pull the Company into a matter that is two decades old from the time of filing the petition.
