In a significant development, the Union Home Minister Amit Shah in Lok Sabha has unveiled the Bharatiya Nyaya Sanhita (BNS) Bill, designed to replace the age-old IPC.

Clause 101(2) of the BNS Bill offers a distinct explanation of mob lynching as a coordinated act of murder rooted in factors such as race, caste, religion, and more. Each participant within the group engaged in such actions would face substantial consequences, including the possibility of the death penalty, life imprisonment, or a mandatory minimum of seven years' imprisonment, coupled with a monetary fine. The introduction of the BNS Bill follows a string of notorious cases where individuals fell victim to unfounded rumors and allegations, resulting in their tragic lynching.
Repeatedly, experts have underscored the necessity for a dedicated legal framework tailored to effectively address mob lynching occurrences. The present IPC lacks precise provisions for instances of murder committed by a mob, frequently leading authorities to charge offenders under IPC's Section 302. The proposed provisions within the BNS Bill represent a comprehensive approach to tackling this severe concern, reflecting the government's resolute commitment to curbing mob-driven violence.
