The bill, pending approval since September, aims to provide police protection and ensure a safer environment for Delhi’s legal professionals.
The Delhi High Court has directed the AAP government to provide a status report on the pending Advocates Protection Bill, designed to enhance safety for legal professionals. The directive, issued by Justice Sanjeev Narula, requires the government to submit updates within two weeks, moving the next hearing from February to December 16, 2024.
The court’s action follows a petition by advocates Deepa Joseph and Alpha Phiris Dayal, who have called for legislative measures to protect advocates following incidents of violence, including the murder of senior lawyer Virender Kumar Narwal in April. Represented by advocate Robin Raju, the petitioners cited an October 21 assault on lawyers that led to an FIR at Mehrauli Police Station, underscoring the urgent need for protective legislation.
The draft of the Advocates Protection Act, prepared by the Delhi government’s Law Department, has been awaiting approval since September. The petitioners highlighted a significant increase in violence against lawyers, arguing that it threatens their right to practice and violates constitutional protections for life and personal liberty under Articles 19 and 21.

A law enacted in Rajasthan provides a precedent, offering police protection for advocates facing threats or attacks. The Delhi petitioners argue that a similar law in the capital would alleviate fear, particularly among young lawyers, following several instances of violent altercations and shootings within court premises.
