The Jan Vishwas Bill 2023 has been introduced in the Rajya Sabha today after already being passed in the Lok Sabha. The bill aims to amend several existing provisions, offering relief to individuals involved in minor offenses related to business practices.

If enacted, it will exempt 42 offenses from criminal punishment and instead levy financial penalties. The Jan Vishwas Bill holds great promise for facilitating ease of doing business and transforming the business landscape.

The Jan Vishwas Bill is essentially an amendment bill seeking to modify certain outdated provisions. It will decriminalize minor offenses under 42 laws, allowing individuals to avoid imprisonment and face financial penalties instead. These minor offenses are often barriers to conducting business smoothly in the country.

The proposed legislation covers a wide range of laws, including the Public Debt Act 1944, Pharmacy Act 1948, Cinematograph Act 1952, Copyright Act 1957, Trademarks Act 1999, Railways Act 1989, Information Technology Act 2000, Drugs and Cosmetics Act 1940, Motor Vehicles Act 1988, Food Security and Standards Act 2006, Prevention of Money Laundering Act 2002, Patents Act 1970, Environmental Protection Act 1986, and Motor Vehicles Act 1988, among others.

The bill has been sent to the Joint Parliamentary Committee (JPC) after its introduction in the Lok Sabha on December 22, 2022. The JPC made proposals for amendments to 183 provisions under 42 ministries. These amendments will restrict many offenses falling under these ministries from being categorized as criminal offenses, sparing individuals from lengthy court proceedings.

As a result, people will experience relief from legal hassles, and business operations will become more streamlined.

While the bill will provide respite from legal complexities, some offenses will see an increase in penalty amounts compared to previous laws. However, the overall impact is expected to promote a more conducive environment for both daily life and business endeavors, thereby fostering economic growth and development.
