Four officials at
Delhi's Tihar Central Prison have been suspended, including a deputy
superintendent, two assistant superintendents, and a head warder, following a
serious security lapse. The breach allowed jailed Hurriyat leader Yasin Malik
to physically appear in the Supreme Court, against regulations.
Sanjay Baniwal,
the director general of prisons, has ordered a thorough investigation into the
matter. He stated that the suspended officials are believed to be responsible
for Malik's unauthorized physical presence in the court. Baniwal has made it
clear that Malik was supposed to appear via video conferencing only, making
this incident a significant failure on their part.
Malik, who is
serving a life sentence in a terror funding case, should not have been
physically produced in court, especially given the ban on such actions for
terrorists. Despite the ban, he was escorted by police to the Supreme Court.
Solicitor General Tushar Mehta expressed his concern in a letter to the Union
home secretary, demanding action against prison officials who allowed Malik's
unauthorized appearance.
Mehta emphasized
that Malik is not an ordinary person but someone with a background involving
terror and separatism, having been convicted in a terror funding case. The
security breach occurred during an appeal filed by the Central Bureau of
Investigation, challenging a court order requiring Malik's presence in a trial
related to the killing of four Indian Air Force personnel in Srinagar in 1990
and the abduction of Rubaiya Sayeed, daughter of former Union Minister Mufti
Mohammad Sayeed in 1989.
The Supreme Court
had previously issued a stay order on this requirement and asked Malik to
appear either in person or through a lawyer. However, the order did not permit
his physical presence in court. The authorities are taking this incident
seriously and intend to hold those responsible accountable for their
negligence.
